Campaign agreement (draft)

Not legal advice. Draft for product use only. Not legal advice. Have California employment, consumer-protection, privacy, and municipal counsel review before production or before paying anyone in California.

This draft sits between the brand (“Buyer”) and the operator of Humans.Army for each campaign the Buyer submits. It is not a signed contract until counsel finalizes it and a production clickwrap is approved.

1. What you are buying

Coordination of a managed field activation: scripted operators at locations you specify, within a time window, with proof photos and a post-campaign report. Package size and deposit come from in-product pricing, not from this page.

2. Paid endorsement (FTC)

Every operator will disclose that they are paid to represent your brand, using the locked disclosure line in the product. You may not instruct operators to skip, hide, or bury that disclosure. You are responsible for the truth of product claims in the brief and any edits you make to the main script. Risky claim language is flagged; flags do not make a claim legal.

3. Permits and property

You represent that you will obtain every permit and property permission required for each location (including Santa Monica, the City of Los Angeles, other California cities, parks, beaches, markets, gyms, campuses, and private venues). Humans.Army does not issue permits, does not practice municipal law, and does not warrant that a location is legal to work. Uploading a document does not mean we verified it.

4. No sweepstakes

The campaign is not a sweepstakes, lottery, raffle, or chance-based prize promotion. If you want a contest or giveaway, stop and get counsel — the product will reject that structure.

5. Operators are not your undisclosed agents for employment law

Worker classification of operators is unresolved under California AB 5. This agreement does not make operators your employees or independent contractors by default. You will not tell the public that operators are unpaid fans.

6. Content license

You grant Humans.Army a license to use brand assets solely to run and report on the campaign. Proof photos may appear in your dashboard and report. Do not upload assets you do not have rights to.

7. Deposits and cancellation

If Stripe is configured, a deposit is due before submission. Refunds for rejected or cancelled campaigns are manual in this version. If Stripe is not configured (local/dev), no real charge occurs.

8. Admin gate

We may reject campaigns for compliance, safety, or any other reason. Approval creates missions; it is not a legal opinion that your campaign is lawful.
