Terms of Service (draft)
Not legal advice. Draft for product use only. Not legal advice. Have California employment, consumer-protection, privacy, and municipal counsel review before production or before paying anyone in California.
These Terms govern access to the Humans.Army website and platform (field-activation campaigns for brands, missions for operators, and admin review). The company is operated from Santa Monica, California. If you do not agree, do not use the service.
1. The platform
Humans.Army is a managed marketplace. Software coordinates campaigns; a human administrator gates approvals, assignments, proof review, and payout tracking. There is no self-serve matching and no automated payout of wages or contractor fees.
2. Accounts
You must provide accurate information. Roles are buyer (brand), operator (field worker), or admin (set only in the database). We may refuse, suspend, or deactivate accounts.
3. Buyers
You are responsible for campaign content, claims about your products, obtaining any municipal permits and property-owner permissions, and the FTC paid-endorsement disclosure. You cannot remove the locked disclosure line. Deposits, if collected, are handled by Stripe in test or live mode as configured; refunds are manual in this version.
4. Operators — classification is unresolved
Field work for a company whose core business is field activation raises California ABC-test / AB 5 issues. These Terms do not classify you as an independent contractor or as an employee. We do not collect a W-9 that would assume 1099 status. Pay, if any, is tracked in-product and sent off-platform only after employment counsel has advised. You acknowledge the classification notice in the product.
5. Background checks
Background checks are not enabled. If they are added later they will follow the FCRA (consent, permissible purpose, adverse-action notices). Until then, no one is represented as “background-checked.”
6. Field conduct and permits
Operators must follow the script, speak the disclosure line, and obey venue and city rules. Humans.Army does not issue Santa Monica, City of Los Angeles, or any other permits.
7. No sweepstakes
Campaigns may not be sweepstakes, lotteries, raffles, or other chance-based prize promotions. The product blocks that language.
8. Acceptable use
No illegal activity, harassment, discrimination, health or financial fraud, or attempts to bypass disclosure, location, or safety rules.
9. Disclaimers and limitation
The service is provided “as is.” We do not warrant campaign results, permit sufficiency, or that using the platform is lawful at a given location. To the extent permitted by California law, liability is limited to amounts paid to us for the campaign giving rise to the claim in the prior three months. This does not limit rights that cannot be waived (including certain California consumer and labor rights).
10. Governing law
California law, excluding conflict-of-law rules. Venue: state or federal courts in Los Angeles County, California, subject to any non-waivable rights.
11. Contact
